统合抑或分立:《事业单位人事管理条例》的司法价值、结构功能与优化路径

摘要 《事业单位人事管理条例》(以下简称“《条例》”)在我国事业单位人事管理制度体系中具有“基本法”的地位,但对司法审判的实证考察显示,直接援引、适用该条例的人事争议诉讼案件数量较少,《条例》中的大部分条款处于近乎“休眠”的状态。这一状况并不意味《条例》缺乏实践价值,也不意味对事业单位人事管理进行专门立法缺乏必要性。实际上,《条例》是事业单位人事管理制度体系的总纲,是连接不断丰富发展的具体单行制度的纽带,具有重要的结构性功能。未来应提升《条例》的法律位阶,形成与事业单位的国有公益特性相适应,涵摄各单行制度和专门制度,并与劳动法律制度有统有分的事业单位人事制度体系。 Regulation on the Personnel Management of Public Institutions plays a fundamental role in the personnel management systems of Chinese public institutions.Nevertheless,it turns out that the number of personnel dispute litigation cases direct citing the Regulation is few,and most of them are in a state of“dormancy”according to the empirical investigation of judicial trials.However,this does not mean that the Regulation is short of practicalvalues,or that it is inessential to legislate on personnel management in public institutions.Actually,the Regulation works as a general overview to the personnel management system of public institutions,a link organically connecting the specific system enriching and developing themselves,and shows its importance in function and value as well.In the future,it is recommended with expectation to upgrade the legal hierarchy of the Regulation,to establish a complete personnel system of public institutions,which is supposed to be compatible with the non-profit of publicinstitutions,cover and guide all individual and special systems,and combine with unification and division of labor legal systems.
