交警非现场执法是自动化行政背景下的行政执法新模式,引入自动化方式使传统模式下交警执法面临的人力不足、效率不高等问题得以缓解,自动化行政呈不可逆趋势。但非现场执法的配套法律体系与现阶段的实际运作存在供需矛盾,处罚密度失衡与裁量权被压缩、执法程序不正当、相对人救济难、责任归属等问题亟需解决。为深化行政执法体制改革、维护社会良性运转,有必要剖析交警非现场执法存在的风险挑战,对其进行合法性控制。

Traffic police off-site law enforcement is a new mode of administrative law enforcement in the context of automated administration,the introduction of automated ways to make the traditional mode of traf⁃fic police law enforcement faced by the lack of manpower,inefficiency and so on can be alleviated,automated administration is an irreversible trend.However,the supporting legal system of off-site law enforcement and the current stage of the actual operation of the supply and demand contradiction,the penalty density im⁃balance and discretionary issues,improper law enforcement procedures,the relative relief is difficult,the attribution of responsibility and other issues need to be resolved urgently.In order to deepen the re⁃form of administrative law enforcement system,to maintain the benign operation of society,it is necessary to analyze the traffic police off-site law enforcement risks and challenges,and its legitimacy control.
