网络恶势力司法认定的困境与出路——基于同质解释规则的展开

Dilemma and Outlet of Judicial Identification of Evil Force Crimes in Cyberspace:An Exposition Based on Homogeneous Interpretation

互联网时代,网络恶势力呈现组织结构松散化、犯罪手段软暴力化、危害范围虚拟化等特点,以至于传统的概念化思维无法指导司法实践妥当认定网络恶势力。为兼顾法益保护与罪刑法定原则,司法机关可考虑转用同质解释规则,即在法益保护原则的要求下,强调构成要件的类型化,立足危害范围的“公共性”、恶势力的“共犯性”以及软暴力的实质危害性,精准界定网络恶势力的构成特征,为实践认定难题提供合理的解决方案。

In the Internet era,the evil force crimes in cyberspace have shown the characteristics of loose organizational structure,soft violence of criminal methods,and virtualized scope of harm,so that traditional conceptual thinking cannot properly identify this new type of cybercrime.In order to balance the protection of legal interests and the principle of legality,homogeneous interpretation should be used instead.Under the requirements of protection of legal interests,the typology of constitutive elements should be strengthened,based on the publicity of the scope of harm,the complicity of evil forces,and the substantive harm of soft violence methods,to accurately define the composition characteristics of the evil force crimes in cyberspace and provide reasonable solutions to practical problems.
