摘要
为应对预付式消费给传统监管体系提出的挑战,一些地方政府利用信息化、互联化的优势,探索建立统一的互联网监管平台。这些平台存在着备案参与度低、平台风险警示制度缺乏互联互通等困境,究其根源是由于政府管控型监管理念与风险预防逻辑不适应;监管权力配置模式过于僵化;制度规范滞后于监管需求;监管工具的创新性不足。为治理上述困境,亟需从政府管控监管理念转换为多元协同监管理念;构建“部门协同、社会共担”的监管权力配置格局;健全“风险预防、程序保障”为导向的监管规范体系;创新监管工具以提高风险预防的精准性等四个方面的改革路径,为治理政府主导型预付式消费互联网平台的监管困境提供思路。
In order to cope with the challenges posed by prepaid consumption to the traditional regulatory system,some local governments have explored the establishment of a unified Internet regulatory platform by taking advantage of the advantages of informatization and interconnection.These platforms have some difficulties,such as low participation in filing,lack of interconnection of platform risk warning system and so on,the root of which is that the concept of government-controlled supervision is not suitable for the logic of risk prevention,the allocation mode of regulatory power is too rigid,the system norms lag behind the regulatory needs,and the innovation of regulatory tools is insufficient.In order to deal with the above dilemma,it is urgent to transform the concept of government control and supervision into the concept of multi-coordinated supervision,to build a regulatory power allocation pattern of“department coordination and social sharing”,to improve the regulatory normative system oriented by“risk prevention and procedural guarantee”,to innovate regulatory tools and improve the accuracy of risk prevention,totally the four aspects of reform path above,in order to deal with the regulatory dilemma of government-led prepaid consumer internet platform.
