The Legal Nature of Individual Credit Right and Its Restructuring

信用的“个体权利性”与“社会义务性”构成信用权法权化的逻辑前提。信用权法权化时信用的二维法权基础以及信用权客体容量的有限性与本体法权所需表达内容的过载性,根本性地影响着信用权的法权化表达与性质定位,既往信用法权化中“信用权利说”的逻辑预设更是困扰着信用权的法权定格。信用二维法权机理的定在性,使得需重新矫正并定位信用为“权义复合型”(信用既属权利,亦属义务)。后法典化时代,基于信用“权义复合型”的性质重置,需微观化调适信用权“保有—利用—维护”三维权能体系之内容构成,并体系化建构以预防义务和排除义务为核心的“信用基础义务结构”、以信用强制维持义务为内在的“信用派生义务结构”。

The“individual right”and“social obligation”of credit constitute the logical premise of legalization of credit right.When the credit right is legalized,the two-dimensional legal right basis of credit,the limited object capacity of credit right and the overload of the content require by the ontological right to credit,fundamentally affect the legal expression and nature orientation of credit right,and the logical presupposition of“credit right theory”in previous credit legalizations have increasingly troubled the legal definition of credit right.The certainty of the two-dimensional legal right mechanism of credit makes it necessary to rectify and position credit as a“compound right and obligation”(credit belongs to both rights and obligations).In the post-codification era,based on the nature of the“compound right and obligation”of credit,it is necessary to micro-adjust the content composition of the three-dimensional power of“retention-utilization-maintenance”of credit right,and systemically construct the“credit foundation obligation structure”with the prevention obligation and the exclusion obligation as the core,and the“credit derivative obligation structure”with the compulsory maintenance obligation as the internal.
