Investigation and Management of Telecom Fraud Crime Based on Fund Investigation and Control

在电信网络诈骗犯罪中,资金流贯穿于整个犯罪过程,将资金查控作为治理电信网络诈骗犯罪的切入点具有重要的价值和意义。从案件流出发,发现资金查控在电信网络诈骗犯罪侦查治理中存在证据层面、数据层面和人才层面三方面问题,由此对电信网络诈骗犯罪的预防、打击、被害人资金返还及案件证据链构建产生消极影响。上述问题及影响的成因主要与对电信网络诈骗犯罪的证据认证体系、数据管理以及人才培养体系存在密切关系。未来应建立区块链证据认证体系、建立违法资金查控专业数据库、建立资金查控专业人才培养体系、构建资源、技术共享交流平台、建立公安机关与金融单位的合作机制相结合的电信网络诈骗犯罪的侦查治理路径。

In telecom fraud crime,capital flow runs through the whole crime process,so it is of great val-ue and significance to take fund investigation and control as the starting point to control telecom fraud crime.Starting from the case flow,it is found that there are three problems in investigation and management of tele-com fraud crime:evidence level,data level and talent level,which has a negative impact on prevention and combat of telecom fraud crime,return of victims'funds and construction of case evidence chain.The causes of the above problems and impacts are closely related to the evidence certification system,data management and talent training system of telecom fraud crime.In the future,we should establish a blockchain evidence certifi-cation system,a professional database for illegal fund investigation and control,a professional talent training system for fund investigation and control,build a resource and technology sharing exchange platform,and es-tablish a cooperation mechanism between public security organs and financial units to investigate and combat telecom fraud crimes.
