基于情境预防理论的环境犯罪治理研究

A Research on Environmental Crime Management based on Situational Prevention Theory

针对环境犯罪带来的系统性风险,传统的社会预防和司法预防无法达到理想的预防犯罪的效果。情境预防在预防环境犯罪上具有理论上的必要性和操作上的可行性。以犯罪是人与情境互动作用产生的行为这一理论为基础,通过对环境犯罪具体情境的设计和改造,构建增加困难、提升风险、降低收益、减少刺激以及排除借口等类别的环境犯罪情境预防体系,可以有效地减少环境犯罪的机会,降低环境犯罪的社会危害程度。

In view of the systematic risk brought by environmental crime,traditional social prevention and judicial prevention can not achieve the ideal effect of crime prevention.Situational prevention has theoretical necessity and operational feasibility in preventing environmental crime.Based on the theory that crime is the behavior produced by the interaction between people and situation,through the design and transformation of the specific environment of environmental crime,the situational prevention system of environmental crime can be constructed to increase difficulties,increase risks,reduce benefits,reduce incentives and eliminate excu-ses,which can effectively reduce the opportunity of environmental crime as well as its social harm.
