摘要
灵活就业在我国劳动力市场中发挥重要作用,但灵活就业人员职业伤害保障制度总体缺失一直是影响劳动者权益和工伤保险制度本身长远发展的重要方面。解决灵活就业人员职业伤害保障问题,无法采取“一刀切”方式,需要在厘清灵活就业人员构成基础上,根据当前保障政策和实践探索情况,多措并举,分类施策。基本思路是:对于能够纳入现有工伤保险制度的应当尽量纳入;对于能够纳入当前新就业形态人员职业伤害保障制度试点的应当尽量纳入;对于既难以纳入工伤保险制度,也难以纳入现有职业伤害保障试点的灵活就业人群,应当为其提供专门的参保政策和渠道。
Flexible employment plays an important role in China's labor market,but the overall lack of occupational injury protection system for flexible workers has affected rights and interests of workers and the long-term development of the work injury insurance system.To solve the problem,a"one size fits all"approach cannot be adopted.It is necessary to clarify the composition of flexible employment personnel and implement classified policies based on current protection policies and practical cases.For those who can be included in the existing work injury insurance system,they should be included as much as possible.For those who can be included in the pilot of the occupational injury protection system for current new forms of employment,they should be included as much as possible.For flexible employment groups that are difficult to incorporate into the work injury insurance system and existing occupational injury protection pilot programs,specialized insurance policies and channels should be provided for them.
