西双版纳州野生动物肇事特征与理赔补偿机制研究

STUDY ON THE CHARACTERISTICS OF WILDLIFE INCIDENTS AND CLAIMS COMPENSATION MECHANISM IN XISHUANGBANNA PREFECTURE

通过深入探讨西双版纳州野生动物肇事特征与理赔补偿机制,揭示了导致野生动物肇事的多重生态学和社会经济学因素,及其对现行理赔补偿机制的影响。研究发现,栖息地变化、食物可用性的季节性变动、人类活动的增加及地理文化特性是推动肇事事件的主要生态和社会因素。尤其是对于大型动物如亚洲象,生存空间的压缩及食物短缺迫使其更频繁侵入人类地区,引发冲突。同时,社会经济活动的扩张加剧了人兽冲突,提升了理赔需求。对于理赔机制,虽然西双版纳州建立了较为完善的法律政策框架,但在资金稳定性、程序效率和预防措施方面存在不足。针对这些问题,研究提出了改进现有机制的策略,包括资金来源多元化、理赔程序优化、提升社区参与度及加强预防措施。同时,建议构建新的理赔补偿机制,以更高效、公正、可持续地应对野生动物肇事所带来的挑战。

This study provides insights into the characteristics of wildlife incidents and compensation mechanisms in Xishuangbanna Prefecture,revealing the multiple ecological and socio-economic factors contributing to wildlife incidents and their impacts on existing compensation mechanisms.The study found that habitat changes,seasonal variations in food availability,increased human activities and geo-cultural characteristics were the main ecological and social factors driving incidents.Particularly for large animals such as Asian elephants,compressed living space and food shortages force them to invade human areas more frequently,triggering conflicts.At the same time,the expansion of socio-economic activities has exacerbated human-animal conflicts and increased the demand for claims.For the claims mechanism,although Xishuangbanna has established a relatively sound legal policy framework,there are deficiencies in terms of financial stability,procedural efficiency and preventive measures.To address these problems,the study proposes strategies to improve the existing mechanism,including diversification of funding sources,optimisation of claims procedures,enhancement of community participation and strengthening of preventive measures.At the same time,it suggests constructing a new claims compensation mechanism to address the challenges posed by wildlife incidents more efficiently,fairly and sustainably.The significance of this study lies in the fact that it not only provides a scientific basis and practical guidelines for specific wildlife management in Xishuangbanna,but also provides a reference for wildlife at-fault management in other regions or similar ecological environments.Through the implementation of these strategies and measures,it is expected that a more just,efficient and sustainable wildlife accident compensation mechanism will be realised in the future,opening up a new path for the harmonious coexistence of man and nature.
