我国海洋特别保护区制度变迁研究

The Institutional Change of Marine Special Protected Areas in China

贯穿我国海洋特别保护区制度建设过程的主题是基于保护的开发以及与开发相协调的保护,但实践中这一主题在保护与开发2个端点之间游移,未实现制度设计的初衷,又因体制机制改革而发生制度变迁。新时代海洋自然公园制度、海洋自然保护区制度替代海洋特别保护区制度,并与海洋生态保护红线制度等相关制度相互配合,协同推进海洋自然保护地的分类分区管控。

The theme throughout the process of institutional construction of marine special protected areas is based on the development of protection and the protection coordinated with development.This theme shifted between the two endpoints of protection and development in practice,which had not realized the original intention of institutional design,and had undergone institutional changed due to the reform of institutional mechanisms.In the new era,the marine nature park system and the marine nature protected areas system superseded the marine special protected areas system,and cooperated with the marine ecological protection red line system and other related systems,to jointly promote the classification and zoning control of marine nature reserves.
