约见制度:社会组织监管范式的嵌入与重构--基于H省案例的考察

Appointment system:Embedding and Reconstruction of Social Organization Supervision Paradigm:A Case Study of H Province

我国实施“放管服”改革,在审批市场领域准入登记方面,实施“不见面”办理;在事中事后监管方面,实行“宽进严管”政策措施;在监管举措方面,确立了企业信息公示制度,全面实施“双随机一公开”监管,从过去以审批为主的准入监管向事中事后监管转变。社会组织政府登记监管与企业登记监管相近而不相同,但在政府登记监管“放管服”制度的传导下,同样需要向“宽进严管”方向探索。本文以H省社会组织登记管理机关实施的约见制度为考察对象,研究对社会组织监管范式的嵌入和重构。本文发现,约见制度的实施已成为一种贯穿事前事中事后全过程的监管新机制,实现了“约谈之前先约见,约见之后再约谈”的辩证有机治理和逻辑演变,推动社会组织登记管理门槛“两降两增”。本文旨在探索三个方面:第一,如何搭建政社互动的桥梁和纽带,形成良性互动机制;第二,如何强化责任意识和道德规范,约束法定代表人自律;第三,如何将监管机制转化为监管效能,推动社会组织健康发展。

China implements the reform of“discharge control service”system,implements“non-meeting”handling in the examination and approval of market access registration,implements“wide entry and strict management”policy measures in the aspect of supervision after the event.In terms of regulatory measures,the enterprise information disclosure system has been established,and the“double random-one open”supervision has been fully implemented,shifting from the approval-based access supervision in the past to the post-event supervision.The government registration supervision of social organizations is similar to but not the same as the registration supervision of enterprises,but under the conduction of the“discharge control service”system of government registration supervision,it is also necessary to explore the direction of“wide entry and strict management”.This paper takes the appointment system implemented by the registration and management authority of social organizations in H province as the object of investigation,and studies the embedding and reconstruction of the supervision paradigm of social organizations.The study found that the implementation of the appointment system has become a new regulatory mechanism that goes through the whole process,realizing the dialectical organic governance and logical evolution of“schedule a meeting first,then schedule a conversation”,and promoting the“two drops-two increases”in the registration management threshold of social organizations.This study aims to explore three aspects:first,how to construct the bridge and bond between the government and the community to form a benign interaction mechanism;Second,how to strengthen the sense of responsibility and moral norms to restrain the self-discipline of legal representatives;Third,how to transform the regulatory mechanism into regulatory effectiveness and promote the healthy development of social organizations.
