礼尚往来中“情”与“纪”的界限研究

A Study of the Boundaries between“Love”and“Discipline”in the Exchange of Courtesies

礼尚往来作为维系人与人之间情感关系的重要纽带,至今仍扮演着重要角色,具有深厚的历史文化基础,应当予以尊重。在市场经济背景下,人情与权力交织,异化的礼尚往来违背了礼尚往来的初衷和本质,其消极效应日益凸显。同时,规制礼尚往来的相关规定存在“情”与“纪”的界定标准模糊、“纪”与“法”的衔接冲突及地方的礼尚往来界定标准不合理等问题,这使一些官员对礼尚往来问题产生错误的认识甚至走向腐败。为此,面对新的社会环境,有必要厘清礼尚往来的界限,对非正常礼尚往来即腐败,在学理和党规党纪中予以严格界定与规制。本文认为,应通过设定“情”与“纪”相协调的礼尚往来参考原则,完善礼尚往来的识别标准,对收受礼金数额较大的,加大纪律整治力度等措施,重新划分“情”与“纪”的界限,使之成为党员干部辨明权力行使方向和预防惩治腐败的标尺与灯塔。

As an important link to maintain the emotional relationship between people,courtesy still plays an important role,with a deep historical and cultural basis,should be respected.In the context of the market economy,the intertwining of human feelings and power,the alienation of courtesy and exchange,contrary to the original purpose and essence of courtesy and exchange,its negative effects are increasingly prominent.At the same time,the relevant provisions regulating courtesy and exchange have a vague definition standards of“Love”and“Discipline”,the confl ict between“discipline”and“law”and the local defi nition of courtesy and exchange unreasonable standards,this resulting in some offi cials on the issue of courtesy and exchange of misconceptions and even to corruption.To this end,in the face of the new social environment,it is necessary to clarify the boundaries of courtesy and exchange,to abonormal counrtesy,namely corruption,in the doctrine and party rules and regulations to be strictly defined and regulated.By setting a reference standard for proper courtesy that coordinates“Love”and“Discipline”;at the institutional level,refi ning the courtesy,improving the way of setting norms,incorporating material benefi ts and service benefi ts into quantitative standards;and strengthening disciplinary measures for those who receive large amounts of gifts,the“love”and“discipline”will be redefi ned the boundary,so that it becomes the party members and cadres to identify the direction of power and prevent and punish corruption of the ruler and lighthouse.
