就业性别歧视劳动监察机制的完善路径

摘要 2023年施行的新《妇女权益保障法》增加了就业性别歧视的劳动监察机制,体现了以行政手段预防和制止就业性别歧视的中国之治。由于就业性别歧视行为的特殊性,就业性别歧视劳动监察机制在执法手段、监察范围及部门衔接等方面存在规范上的不足,而就业性别歧视行为同时侵害社会公益、女性私益的特殊挑战使该机制执法乏力。应分别在行政公益、行政介入实施机制方面,强化就业性别歧视劳动监察机制的处罚力度,赋予劳动监察机构以裁决权,并与劳动仲裁机构建立协作机制,与司法机关就裁决认定达成共识,使就业性别歧视劳动监察机制更好地发挥作用。 In 2023,the revised“Law on the Protection of Women’s Rights and Interests”newly added a labor supervision mechanism,which reflects the governance of China in preventing and combating gender discrimination in employment through administrative enforcement.Due to the characteristics of gender discrimination in employment,the labor supervision mechanism for gender discrimination in employment has exposed many shortcomings in administrative enforcement tools,supervision scope,and departmental connections.At the same time,the gender discrimination in employment harms the public interests and women’s private interests,which leads to the weakening enforcement of the mechanism.Therefore,we should strengthen the punishment of the labor supervision mechanism for gender discrimination in employment,empower the administrative adjudication to labor supervision agencies,establish a coordinated mechanism with the labor dispute arbitration committee,and reach consensus with judicial authorities on the determination of administrative adjudication.On this basis it will help the labor supervision mechanism addressing gender discrimination in employment work better.
