“实体—程序”交错视域下农村集体土地征收的制度优化

Study on the Optimization of Rural Collective Land Expropriation System from the Perspective of"Entity-Procedure"

通过文本梳理及实证调研发现,我国农村集体土地征收制度存在公共利益认定程序缺失、征收补偿标准不合理、征收程序不符合正当程序要求等问题。在明确公共利益的界定标准上,应坚持公平性原则、效率性原则并接受比例原则的调和,同时设立对应的认定方法;在优化土地征收补偿机制上,应确立“合理补偿+市场衡量”原则作为土地征收补偿的一般原则,同时适当扩大土地征收补偿范围,并建立多元化的补偿标准和方式;在征收程序上,应在正当程序的指引下重塑土地征收程序,并构建涉土地征收多元化纠纷解决机制。

Through textual combing and empirical research,it is found that China's rural collective land expropriation system suffers from the lack of public interest determination procedures,unreasonable expropriation compensation standards,and expropriation procedures that do not meet due process requirements.On the criteria for defining public interest,China should adhere to the principles of fairness and efficiency and accept the reconciliation of the principle of proportionality.At the same time,we should/establish a corresponding method of identification;On optimizing the compensation mechanism for land acquisition,China should establish the principle of"reasonable compensation+market measurement"as the general principle of compensation for land acquisition,while appropriately expanding the scope of compensation for land acquisition,and establishing diversified compensation standards and methods;In terms of expropriation procedures,China should reshape land expropriation procedures under the guidance of due process and build a diversified dispute resolution mechanism for land expropriation.
