Identification of Behavioral Attributes for Liability Determination in Water Traffic Accidents and Suggestions for Liability Determination

新《中华人民共和国海上交通安全法》明确指出,在管辖海域内发生的海上交通事故,由海事管理机构负责调查认定事故责任,出具的事故责任认定书作为处理海上交通事故的证据。从行政行为概念的厘定和特征梳理切入,辨析海事管理机构作出水上交通事故责任认定书的认定行为是否属于行政行为,并对海事管理机构进一步做好水上交通事故责任认定工作提出建议。

The newly revised Maritime Traffic Safety Law of the People's Republic of China clearly stipulates that the maritime administrative agency shall be responsible for the investigation and determination of the liability for maritime traffic accidents that occur in the sea areas under its jurisdiction,and the certificate of liability determination issued by the maritime administrative agency shall be used as evidence for handling maritime traffic accidents.This article starts with the definition and characteristics of the administrative act,and analyzes whether the determination of maritime traffic accident liability by maritime management agencies belongs to administrative act.Furthermore,it puts forward suggestions for maritime administrative agencies to further improve the identification of liability for maritime traffic accidents.
