Study on the Construction of Administrative Procuratorial Integrated Supervision Mechanism

当前检察机关开展行政检察监督工作面临双重挑战:一方面,全面深化行政检察增加了行政检察的工作职责,提高了检察机关的履职要求,检察机关亟需增强行政检察的履职能力;另一方面,法院实施行政诉讼案件一审集中管辖改革后,造成了行政检察监督机制失衡、异地监督能力不足、矛盾纠纷化解难度增加等问题。检察机关可以从两个方面应对:一是建立行政检察一体化办案机制,构建信息交互平台与多功能协调系统,建立健全行政争议实质性化解机制,完善案件集中管辖后各地检察机关之间的衔接,全面提升检察机关行政检察一体化监督能力;二是主动回应国家治理和法治政府建设需求,全面深化行政检察监督理念,明确行政检察监督职权范围,探索行政检察监督新领域、新路径,推动法治政府建设,完善党和国家的权力监督体系。

Procuratorial organs face double challenges in carrying out administrative procuratorial supervision.On the one hand,administrative procuratorial organs bear more duties and tasks,and are given higher requirements for performing their duties.On the other hand,after the court implemented the reform of centralized jurisdiction over first-instance administrative litigation cases,it caused problems such as the imbalance of administrative procuratorial supervision mechanism,the lack of supervision ability in different places,and the difficulty of resolving contradictions and disputes.Procuratorial organs can respond from two aspects:first,establish an integrated case handling mechanism of administrative procuratorial organs,build an information exchange platform and a multi-functional coordination system,establish and improve the substantive resolution mechanism of administrative disputes,improve the connection between local procuratorial organs after centralized jurisdiction,and comprehensively improve the integrated supervision capacity of procuratorial organs.Second,proactively respond to the needs of national governance and the construction of a law-based government,Clarify the scope of administrative procuratorial supervision,comprehensively deepen the concept of administrative procuratorial supervision,explore new areas and new paths of administrative procuratorial supervision,promote the construction of a law-based government,and improve the power supervision system of the Party and the state.
