From Supervision to Governance:Practical Experience and Theoretical Interpretation of Administrative Inspection to Optimize Business Environment

作为法律监督机关的检察院通过对政府和市场主体的监督,对优化营商环境发挥了重要作用。本文以检察院对典型政府执法不当和市场违法现象的行政检察为例,分析优化政府市场关系的监督逻辑。文章认为,行政检察折射出“政府”内涵的中国特色,它以公权力分工合作的方式提供了整体性政府治理的新方案。作为连接政府与市场的中介、平衡和优化机制,行政检察以法治化的方式重塑了政府市场关系,为优化营商环境提供动力。行政检察参与优化营商环境的经验事实,进一步为中国公共行政的自主知识体系建设提供了鲜活素材。

As a legal supervision organ,procuratorate has played an important role in optimizing the business environment.This paper takes the administrative prosecution of improper government law enforcement and market violations by the procuratorate as an example to analyze the supervisory logic for optimizing government market relations.The paper argues that the administrative inspection provides a new scheme for the construction of the integral government by means of the division of public power and cooperation,which reflects the Chinese characteristics of the connotation of“government”.As the mechanism of intermediary agent,balance and optimization connecting the government and market,administrative inspection has reshaped the relationship of government and market through legalization,and continuously provided impetus for the reform of government functions.The empirical fact of administrative inspection participating in the reform of supervision functions further provides live material for the construction of public administration's autonomous knowledge system.
