摘要
“德法兼修”是新时代法律职业伦理教育的核心目标,这意味着法科学生不仅要熟悉法律职业行为规则,而且还要提升个人的道德判断力。就我国当前的法律职业伦理教育而言,在理念上,存在重法律规则而轻道德伦理的问题;在方法上,以法教义学为主导的传统教学方法存在效果不彰的问题。因此,法律职业伦理教育亟待进行变革和完善。虚拟现实技术具有沉浸性、交互性和构想性三个特征,能够应对数字原生代学习风格的转变所带来的挑战。建构主义学习理论和情境化学习理论可以为虚拟现实嵌入法律职业伦理教育提供理论支撑。相较于传统的教学模式,虚拟现实可以提升法律职业伦理教育的现实性、参与性和可访问性等。为了在数字时代实现德法兼修这一教育目标,我国可以完善虚拟现实嵌入法律职业伦理教育的实践路径:确立“VR+法律职业伦理”的实施过程;开发“VR+法律职业伦理”的技术设备;拓展“VR+法律职业伦理”的应用场景;提升“VR+法律职业伦理”的参与实效。
The core goal of legal ethics education in the new era is to make“cultivation of morality and law”,which means that law students should not only be familiar with the rules of legal professional conduct,but also improve their moral judgment.In China’s current legal ethics education,in terms of teaching philosophy,there is a problem of emphasizing legal rules while ignoring moral ethics;In terms of teaching methods,the traditional teaching methods dominated by legal dogmatics have the problem of ineffectiveness.Therefore,legal ethics education urgently needs to be reformed and improved.Virtual reality technology has three characteristics like immersion,interaction and imagination,which can meet the challenges brought about by the transformation of the learning style of digital natives.Constructivism learning theory and situated learning theory can provide theoretical support for embedding virtual reality in legal ethics education.Compared with the traditional teaching mode,virtual reality can enhance the reality,participation and accessibility of legal ethics education.To achieve the educational goal of making the cultivation of morality and law in the digital era,China should improve the practical path of embedding virtual reality into legal ethics education:establish the implementation process of“VR+legal ethics”,develop“VR+legal ethics”technical equipment,expand the application scenarios of“VR+legal ethics”,enhance the effectiveness of participation in“VR+legal ethics”.
