党内法规和国家法律的关系构造--以党的政策转化为视角

Revisting the Relationship Between Intraparty Rules And Regulations and National Laws:From the Perspective of the Party's Policy Transformation

既有关于党内法规和国家法律关系的讨论多采用二元对照的线性思维,容易导致对更为宏阔的治理场域下两套规范体系关系定位的忽视,进而弱化相关理论的现实诠释力。在我国实际政治生活中,党的政策为党内法规和国家法律的制度创建供给了实质内容。因此,观察党内法规和国家法律的关系,应将党的政策带入研究视野,形成党的政策、党内法规和国家法律的立体三维结构,这也有助于分析和理解中国共产党领导下的中国法治道路的一些关键特征。从三维结构出发,党内法规不是对党的政策的简单延续,国家法律并不必然构成党的政策转化的最终形态表现;在党的政策的转化中,党内法规、国家法律也不存在更优法治形式的比较。在中国共产党治理法治化的语境下,党的政策、党内法规和国家法律能够经由实质价值与形式价值的有机结合而呈现出内在统一性;在转化党的政策的过程中,党内法规、国家法律也会因各自功能定位的区分而具有相对独立性。

The existing discussions on the relationship between intraparty rules and regulations and national laws often adopts a linear thinking of binary comparison,which tends to neglect the positioning of the relationship between the two sets of normative systems in a broader governance field,and thus weakens the realistic interpretation of the relevant theories.In China's actual political life,the party's policies provide substantive content for the institutional creation of intraparty rules and regulations and national laws.Therefore,to observe the relationship between intraparty rules and regulations and national laws,the“party's policies”should be brought into the research field,forming a three-dimensional structure of party policies,intraparty rules and regulations and national laws,which also helps to analyze and understand some key characteristics of China's rule of law path under the leadership of the Communist Party of China.From the perspective of the three-dimensional structure,intraparty rules and regulations are not a simple continuation of the party's policies,and national laws do not necessarily constitute the final form of expression of the transformation of the party's policies;in the transformation of the party's policies,intraparty rules and regulations and national laws do not compare with each other as better rule of law forms.In the context of the rule of law governance of the Communist Party of China,the party's policies,intraparty rules and regulations and national laws can present an internal unity through the organic combination of substantive value and formal value;in the process of the transformation of the party's policies,the intraparty rules and regulations and national laws will also have relative independence due to the distinction of their functional positioning.
