气候变化下我国能源法律制度问题研究

应对气候变化、推进能源产业发展向绿色低碳转型,需要有相应的能源法律制度来发挥支持和保障作用。我国当前的能源法律制度存在明显滞后,在结构上缺失基本法、在内容上应对气候变化能力不足、相关能源法律制度操作性低等问题突出。有必要充分借鉴各发达国家能源法制的发展经验,提出完善我国应对气候变化能源法律制度的构想。需补足基本法缺失问题,填充单行法、专项法中有关应对气候变化的理念,并对相关法律制度进行完善创新,为我国能源在应对气候变化上提供法律支持。

To address climate change and promote the green and low-carbon transformation of energy industry,corresponding legal systems are needed to provide support and safeguard.There is a significant lag in China's current energy legal system,with prominent issues such as the lack of basic laws in structure,insufficient capacity to respond to climate change in content,and low operability of relevant energy legal systems.It is necessary to fully draw on the development experience of energy legal systems in developed countries and propose the concept of improving China's energy legal system to address climate change.It is necessary to draw on the development experience of developed countries in the field of energy law and propose a conceptual framework for improving China's legal system for addressing climate change in energy.This includes filling the gaps in basic laws,incorporating climate change concepts into single laws and special laws,and innovating and improving relevant legal systems to provide legal support for China's energy sector in addressing climate change.
