替代医疗方案告知是实施手术、特殊检查、特殊治疗不可或缺的环节,是侵袭性医疗行为违法阻却事由,也是患者知情同意内容的完善。《民法典》明确了医疗告知对象、方式及侵权责任,对医务人员履行告知义务提出了更高要求。为此,通过分析《民法典》实施背景下替代医疗方案告知缺陷的法律风险,提出应对策略,以期更好地规避风险,合理保护医患双方的合法权益。

Informing alternative treatment or procedure selection is an indispensable part of carrying out operation,special examination and special treatment.It is not only the cause of illegal prevention of invasive medical behavior,but also the perfection of the content of informed consent of patients.The Civil Code defines the objects,methods and tort liability of medical disclosure,and puts forward requirements for medical personnel to fulfill their disclosure obligations.By analyzing the legal risks of informing about the defects of alternative treatment or procedure selection under the background of the implementation of the Civil Code,countermeasures are put forward so as to better avoid risks and reasonably protect the legitimate rights and interests of both doctors and patients.
