论积极刑法观下高空抛物罪的扩张与限制

The Expansion and Limitation of the Crime of Throwing Objects from High Altitude under the Positive Criminal Law Perspective

积极刑法观主张刑法应对社会潜在危险作出提前预防,高空抛物罪就是积极刑法观指导下的立法,天然具有潜在的扩张风险,一旦扩张将会引发泛刑化问题,无形中还会虚化民法的力量,激化社会矛盾,造成非良性循环。为应对高空抛物罪潜在扩张风险,从程序法和实体法两个方向探索限制高空抛物罪扩张新路径:一是程序法方向的“高空抛物附条件不起诉制度”;二是实体法方向的“民刑行分层共治模式”。

The crime of throwing objects at high altitude is the legislation under the guidance of the positive criminal law view,which naturally has the potential risk of expansion.Once expanded,it will lead to the problem of universal punishment,which will virtually blur the power of civil law,intensify social contradictions,and cause a non-virtuous circle.In order to deal with the potential expansion risk of high-altitude throwing crime,new ways to limit the expansion of high-altitude throwing crime are explored from two directions of procedural law and substantive law.Firstly,the“high-altitude parabolic conditional non-prosecution system”in the direction of procedural law;the second is the“layered co-governance mode of civil punishment”in the direction of substantive law.
