数字能力鸿沟是基于数字生活能力而产生的一种新型数字鸿沟,它会引发技术赋权的不均衡性、能力鸿沟的自我强化、权利能力与行为能力的张力以及对尊严和平等价值的消解等深层问题与困境,从而对数字法治建设构成严峻挑战。这就需要遵循普惠公平、共建共享的价值原则,通过提高全民数字素养、加强算法治理、构建保障机制以及塑造数智人文生态等法治化路径,解决数字能力鸿沟带来的问题,将数字能力鸿沟转变为“数字能力跳板”,让所有人都能分享数字社会发展红利,促进数字权利的有效实现和可靠保障。

The digital competence divide is a new type of digital divide based on the ability to live digitally,which will lead to deeper problems and dilemmas such as the imbalance of technological empowerment,the self-reinforcement of the capability divide,the tension between the ability of rights and the ability to act,as well as the disintegration of the values of dignity and equality,thus posing a serious challenge to the construction of the digital rule of law.It is necessary to follow the value principle of universality and fairness,common construction and sharing,and solve the problems caused by the digital competence divide through improving the digital literacy of all people,strengthening algorithmic governance,building a guarantee mechanism,and shaping a digital humanities ecosystem and other paths of the rule of law.This will transform the digital competence divide into a“digital competence springboard”,enable all people to share the dividends of digital society development,and promote the effective realization and reliable guarantee of digital rights.
