网络空间命运共同体理念下暗网犯罪的治理模式

Governance Model of Dark Web Crimes Under the Concept of Community of Shared Future in the Cyberspace

暗网是充斥着毒品交易、儿童色情、非法信息买卖、恐怖主义等犯罪行为的网络空间,暗网犯罪已经成为最具危害性且发展迅猛的新型网络犯罪形态之一。西方理念主导下的暗网犯罪多方治理模式存在治理对象不准确、治理技术被滥用、治理主体不充分、治理利益不共享、治理实践碎片化等诸多实践困境,无力应对当前暗网犯罪的现实挑战。网络空间命运共同体理念强调网络空间治理主体的平等性、参与的共同性、利益的均等性和结果的共享性,在该理念的指导下,加强以价值融合和尊重网络主权为前提的包容性治理,推进政府主导与多边参与相结合的协同性治理,构建以信息共享和技术合作为手段的共享性治理,探索形成暗网犯罪三位一体多边治理模式,为暗网犯罪治理贡献中国智慧,提供中国方案。

The dark web is a cyber space filled with drug dealing,child pornography,illegal information trading,terrorism and other criminal activities.The crimes on the dark web have become one of the most harmful and rapidly developing new forms of cybercrime.The multi-party governance model of the dark web crimes led by the western concepts has many practical difficulties,such as inaccurate governance objects,abuse of governance technologies,insufficient governance subjects,non-sharing of governance interests,and fragmented governance practices,which are unable to cope with the current practical challenges of the dark web crimes.The concept of a community with a shared future in cyberspace emphasizes the equality of subjects,the commonality of participation,the equality of interests and the sharing of results in cyberspace governance.Under the guidance of this concept,inclusive governance based on value integration and respect for cyber sovereignty should be strengthened,and collaborative governance combining government-led and multilateral participation should be promoted.A shared governance should be built by means of information sharing and technical cooperation,exploring the formation of a three-in-one multilateral governance model for dark web crimes,and contributing Chinese wisdom and provide Chinese solutions to the governance of dark web crimes.
