摘要
作為一部讓正常市場主體「向死而生」的法律,破產法在擔負挽救危困企業並讓失敗的市場主體規範退出的主要任務時,不斷出現的新型破產形態以及新問題,以至對破產法研究亟待與時俱進。本期聚焦就破產法新問題與新領域組織學者撰文,以期回應理論與現實需求。
As a law that allows normal market entities to"survive from death",the bankruptcy law undertakes the main tasks of saving enterprises in trouble and making failed market entities w ithdraw from the market normatively.Due to constantly emerging new bankruptcy patterns and new problems,the studies on the bankruptey law need to keep pace with the times.In this issue,scholars wrote articles on new problems and new fields related to the bankruptcy law to respond to theoretical and realistic needs.
