What is Law?A Law-and-Anthropology Reflection on Cultural Construction

法律是一种文化的建构,在一定意义上还可能转变成为一种文化霸权。在对法律进行文化解释的同时,不能忽略了作为整体的法律与习俗基于西方理论的二元划分。原始法律的神话构建,支持了西方法律存在的优越感,这种神话在今天的多元文化的背景下受到了瓦解,并且,如果回眸中国的经验,它正在成为今天重新理解法律的文化基础的核心。

Law is a cultural construction.In some sense,it would be transformed into a cultural hegemony.In the cultural explanation of law,therefore,we couldn't neglect a west-centred dualistic division as a whole between law and custom.A mystical construction of primitive law supported the superiority of the exisitence of the westernal law.Today,the myth has been destroyed on the background of multicultural setting which,going back the experience in China,is becoming a core of understaning the cultural basis of law.
