公共利益的实现是一个重要的问题。公共利益的实现一方面关系到公权行使的边界;另一方面也连接着私权表达的限度。公共利益的实现面临着众多的困境,而其所面临的文化困境则是公共利益实现中的深层次问题。概言之,公共利益的实现的文化困境表现在以下五个方面:一是国家观念缺乏造成公共利益实现的主体缺位;二是家国不分的传统造成实现公共利益的观念淡薄;三是由于国家和社会同构而窒息了公共利益实现的舆论空间;四是由于中央集权传统的长期存在而使公共利益的实现过程中缺乏一种整体主义的哲学辩护;五是由于法律儒家化的原因造成公共利益的实现被边缘化。

It is very important in the process of realization of public interest.Both the boundary of public power and the expression limitation of private rights are related to the realization of public interest.There are a series of difficulties in the realization of public interests,while cultural dilemma is very difficult to overcome.In a word,the cultural dilemma of public interest is the following five aspects:Firstly,the public interests subject is vacancy without the concept of country.Secondly,the integration of Family-Country brings on a weak idea of the realization of public interest.Thirdly,the isomorphic Society-Country stifles the public space.Fourthly,there is not any kind of holism philosophy to defense the public interest because of long-term centralization tradition.Finally,the realization of public interest is marginalized by the Confucian legal.
