摘要
南京国民政府在抗战前颁布了民法和土地法,规定了房东对房屋适居性的担保义务、限制租金和退租、准备房屋等措施,以解决当时的房屋问题。抗战爆发后,又颁布了临时性质的房屋租赁条例,以应对当时的“房荒”。尽管在制度设计上存在一些缺陷,在实践中也未能完全贯彻,但南京国民政府对待住宅问题的积极态度应该肯定,其立法上的具体得失也值得今天借鉴。
In order to solve the severe housing problem,the Government of Republic of China enacted the Civic Code in 1929 and the Land Law in 1930 before the Anti-Japan War,establishing public housing,maximum rent,warrant of habitability and other policies.During the war time(1937-1949)the Government enacted three Rent Acts to give relief to the house shortage.Although these statutes were far from perfect and they were not implemented thoroughly because of the war,the government's endeavor in solving housing problems should be given respect.Moreover,we still can learn from these statutes in order to solve the present problem.
