未成年人保护处分制度是以预防未成年人实施犯罪为目的,针对实施了严重不良行为的未成年人所采取的一系列处遇手段。当下保护处分制度内容的模糊不明、实施主体的力量薄弱、具体实施程序的规范缺失、专门学校建设进程缓慢等问题,是影响当前我国保护处分制度实践效果的重要因素。为此,应当明确未成年人保护处分制度的功能定位,并对具体措施的决定程序进行司法化改造。同时,为给保护处分制度的有效落实提供现实抓手,有必要从组建专门的未成年人警务部门、将调查评估工作以政府购买社会服务的方式“外包”,推进专门学校的建设三方面具体展开.
