法治思维视角下刑罚变更执行同步监督制度结构性剖析

Structural Analysis of the Synchronous Supervision System of Penalty Change Execution from the Perspective of Rule of Law Thinking

刑罚的变更执行是摒弃传统的报应论,倡导新社会防卫论下的刑事政策,严格意义的刑罚变更执行监督主要是对减刑、假释、暂予监外执行三种变更方式的监督。检察机关对刑罚变更执行活动实行监督,是检察机关在刑事诉讼活动中履行法律监督职责、维护刑事法律统一正确实施的重要体现。党的十八届四中全会确立全面推进依法治国以来,中央政法委、最高人民法院、最高人民检察院先后出台关于刑罚变更执行改革的意见和规定,确立了人民检察院刑罚变更执行同步监督的定位和路径在当前法治中国的法治思维大背景下,从基层法律监督机关的角度,结合当前深入推动刑罚变更执行案件实质化审理司法实践需求,拟通过对《人民检察院办理减刑、假释案件规定》《暂予监外执行规定》的结构性剖析,谈一谈刑罚变更执行同步监督机制构建的法治背景、体系内涵及推动落实的后续举措,以期在司法实践各个环节中更好地贯彻刑罚变更执行同步监督的外在司法制度及内在司法精髓。

The execution of penalty change is to abandon the traditional retribution theory and advocate the criminal policy under the new social defense theory,mainly to supervise the three ways of commutation,parole and temporary execution outside prison.The procuratorial organ's supervision of the execution of penalty change is an important embodiment of legal supervision and maintenance of the unified and correct implementation of criminal law in criminal proceedings.Since the Fourth Plenary Session of the 18th CPC Central Committee established the rule of law,the Central Political and Legal Commission,the Supreme People's Court,and the Supreme People's Procuratorate have issued opinions and regulations on the reform of the execution of penalty change,and established the positioning and path of simultaneous supervision.Under the background of the rule of law thinking in China,from the perspective of grass-roots legal supervision organs,combined with the current needs of judicial practice to further promote the substantive trial of penalty change execution cases,through the structural analysis of the“Provisions of the People's Procuratorate on Handling Commutation and Parole Cases”and“Provisions on Temporary Enforcement of Sentence Outside of Prison”,this paper studies the legal background,system connotation and follow-up measures of the synchronous supervision mechanism of penalty change execution,in order to better implement the external judicial system and internal judicial essence of the synchronous supervision of penalty change execution in all aspects of judicial practice.
