论中国古代社会的审判官吏

审判官吏是司法制度的重要组成部分,是审判制度的具体操作者、运作者,对纠纷解决、秩序维护、公平实现有着举足轻重的作用。中国古代社会有着独特的法传统,确立了一整套具体而详尽的关于审判官吏的制度规定,如审判官员的选拔任用、待遇、考核奖惩、职权、回避、责任及审判官员的幕吏。

In China of today,the establishment of a perfect,independent and impartial judicial system replies on not only learnig from advanced foreign idea and systems,but also succeeding the intrinsic accomplishments and experience of Chinese society.Based on historical documents,the author makes a preliminary survey into the selection and appointment,remuneration,check standard,powers of office,challenge,liabilities,and the aids and staff and so on of the judicial officers of ancient Chinese society.By doing this the Author tries to comparatively comprehensively disclose the system regulations of the judicial officers of Chinese ancient society,as well as their factual operaiton to some degree.
