高校教师合同预告解除权研究:基于服务期条款法律性质的考察

Research on the University Teachers’Right of Advance Notice to Rescind Contract:On the Basis of the Jurisdiction Clause of Service Period

摘要 服务期条款所引发的高校教师合同解除的人事纠纷日益增多,服务期条款是否排除高校教师合同预告解除权,司法判决存在着争议。然而,从事业单位人事改革基本精神、高校教师聘用合同法律性质和高校教师聘用合同预告解除权法理价值等层面考察,服务期条款并不排除高校教师合同预告解除权。为了保障高校教师合同预告解除权行使的合法性,很有必要使高校教师聘用合同中约定服务期条款的事由、期限和数额符合《劳动合同法》第22条实体规则的要求。 The personnel disputes arising from the termination of university teacher contracts caused by service period clauses are increasing.There is controversy in judicial judgments regarding whether service period clauses exclude university teachers’right of advance notice to terminate contracts.However,from the perspective of the basic spirit of the personnel reform of institutions,the legal nature of the employment contract of university teachers,and the legal value of the right of advance notice to rescind contracts,service period clauses does not exclude university teachers’right of advance notice to rescind contract.In order to guarantee the legality of the right,it is necessary to ensure that the cause,duration and amount of the service period clause agreed in the employment contract of university teachers conform to the requirements of Article 22 of the substantive rules of the Labor Contract Law.
