海南自由贸易港公平竞争审查的困境及优化路径

Dilemma and Solution Path of Fair Competition Review in Hainan Free Trade Port

公平竞争审查制度已在海南自由贸易港全面确立,其制度落实以及机制创新等方面进行了大胆尝试及探索,取得了一定的实施成果。但海南自贸港在公平竞争审查方面仍存在自我审查模式弊端无法克服、审查规则不够细化、第三方评估引入效果不佳以及配套机制不健全等问题。对此,海南自贸港应通过逐步革新自我审查模式、细化审查规则、健全第三方评估机制及制度配套机制等措施予以完善。

The fair competition review system has been fully established in the Hainan Free Trade Port,which has made useful attempts and explorations in terms of mechanism innovation and system implementation,and achieved certain implementation results.However,Hainan Free Trade Port still has the problems of insurmountable drawbacks of self-censorship mode,insufficiently detailed review rules,poor introduction of third-party assessment and unsound supporting mechanism in fair competition review.In this regard,Hainan FTTP should be improved by gradually innovating the self-review model,refining the review rules,and improving the third-party assessment mechanism and the supporting mechanism of the system.
