The Illegal Identification Framework of Unfair Pricing in Antitrust Law

关于不公平高价的认定,在我国的执法实践中,囿于成本核算、利润率界定、价格比较中相关产品难以确定等因素,仍存在很多实际性的困难,如成本测算复杂、利润率界定模糊、相关产品选择基准不明等问题,进而导致不公平高价行为的认定框架模糊、简略。在具体规则完善上,可尝试构建两步骤分析法为不公平高价的分析框架:第一步以“成本-利润”分析价格是否过高,第二步以多种基准价格同被调查价格进行比较,判断价格是否不公平。采取更为直观、明确的不公平高价认定标准,有利于提高反垄断执法的精细度和准确性。

Regarding the identification of unfair high price,in China's law enforcement practice,there are still many practical difficulties due to the difficulties of cost accounting,profit margin definition,and the difficulty of determining related products in price comparison,such as complex cost calculation,vague profit margin definition,and unknown reference of related product selection,which leads to the fuzzy and simple identification framework of unfair high price behavior.In terms of the improvement of specific rules,we can try to build a two-step analysis framework of unfair high prices,which takes"the first step to analyze whether the price is too high by cost-profit,and the second step to compare a variety of benchmark prices with the price under investigation to determine whether the price is unfair",and adopt a more intuitive and clear identification standard of unfair high prices to improve the refinement and accuracy of anti-monopoly law enforcement.
