摘要
专门法院制度是由我国宪法确立,并由人民法院组织法加以规定的法院组织体系,是中国特色社会主义司法制度的重要组成部分。目前,我国专门法院制度存在理念、结构、功能、机制等方面的碎片化现象。为解决这些问题,应当从服务保障中国式现代化的战略高度和长远角度,立足我国司法制度、司法体制和基本国情,坚持整体性思维,推进专门法院理念、结构、功能、机制的完善,实现专门法院高质量发展。
The specialized court system is a court organizational system established by the Constitution and stipulated by the People's Court Organization Law.It is an important component of the socialist judicial system with Chinese characteristics.Due to the overall immaturity and standardization of traditional specialized courts,there is a phenomenon of fragmented concepts,structures,functions,and mechanisms.In order to solve the fragmentation of traditional specialized courts,we should adhere to the holistic thinking from the strategic height and long-term perspective of Chinese path to modernization of service guarantee,promote the improvement of the concept,structure,function and mechanism of specialized courts,and achieve high-quality development of specialized courts.
