企业合规第三方监管机制的反思与完善

Reflection and Improvement of Third Party Supervision Mechanism for Enterprise Compliance

企业合规第三方监管机制在我国的发展并非一蹴而就,而是经历了一个最高人民检察院及相关部门的认识不断深化的过程。当前第三方监管机制存在诸多现实问题,诸如企业合规计划的有效性难以保障,第三方监管机构经费保障亟待完善、监督机制暂付阙如,尤其是缺乏检察机关的主导监督。因此,我国应当建立有效的企业合规计划,探索监管费用的二元给付标准和合理分担路径,加强检察机关对第三方监管机构的全方位监督,以期完善企业合规第三方监管机制,最终为企业营造良好的发展环境,保证企业得以可持续发展。

The development of third-party regulatory mechanisms for enterprise compliance in China is not achieved overnight,but has gone through a process of continuous deepening of the understanding of the Supreme People's Procuratorate and relevant departments.There are many practical problems in the current third-party regulatory mechanism,such as the difficulty in ensuring the effectiveness of enterprise compliance plans,the urgent need to improve the funding guarantee of third-party regulatory agencies,and the lack of supervision mechanisms,especially the lack of leading supervision by procuratorial organs.Therefore,China should establish an effective enterprise compliance plan,explore the dual payment standards and reasonable sharing paths of regulatory costs,strengthen the comprehensive supervision of thirdparty regulatory agencies by procuratorial organs,in order to improve the third-party regulatory mechanism for enterprise compliance,with the ultimate goal of creating a good development environment for enterprises and fully ensuring that enterprises follow the path of sustainable development.
