妨害药品管理罪教义学分析

Doctrinal Analysis of the Crime of Impairing Pharmaceutical Administration

缘于2019年《药品管理法》对假药与劣药概念的修订而产生的处罚漏洞,在解释学上,可以把妨害药品管理罪规制对象的药品扩大为原料药,受罪刑法定的约束,不能包括“直接接触药品的包装材料和容器”。该罪的实行行为之一的编造行为实质上是一种出于流通目的实施的危及人体健康的行为,并且编造药品包装材料与容器的生产、检验记录也能被编造行为所涵摄,却无法规制“必须检验而未经检验”的药品类型。鉴于将该罪的四种实行行为划分为生产、销售以及弄虚作假两大类行为的情况下,其“从一重处断”条款可作为法条竞合的特别关系(例外规定)、想象竞合、牵连犯之处置原则的表征。

Due to the penalty loophole caused by the revision of the concept of fake and substandard drugs in the Drug Administration Law 2019,in hermeneutics,the drugs that are regulated by the crime of impairing drug administration can be extended to raw materials,subject to the restriction of legal punishment,and cannot include"packaging materials and containers in direct contact with drugs".One of the perpetrating acts of fabricating the crime is essentially a behavior that endangers human health for the purpose of circulation,and the production and inspection records of fabricated drug packaging materials and containers can also be included in the fabricating behavior,but it cannot regulate the types of drugs that must be inspected but have not been inspected.Given that the four types of perpetrating actions of this crime are divided into two categories:production and sales and fraud,the terms of"Convicted and punished in accordance with the heavier provision"can be used as a representation of“overlap of articles of law”of special relationship(exception provisions),imaginative joiner of offenses,and the principle of implicated offender.
