第三方支付作为新型支付模式,在实践中极大地凸显了效率优势,但在法律价值的学理层面仍可进一步探讨。一方面,第三方支付的三元结构与传统支付结构之间的区别与独特性,使得未授权交易规范在第三方场景中无法有效适用;另一方面我国第三方支付未授权交易机制的现实操作性不强。虽然我国第三方支付未授权交易解决机制在形式上已表现出体系化的特点,《中华人民共和国电子商务法》等的颁布与实施也呈现出保护支付用户权益的思维。然而,第三方支付未授权交易概念缺位、举证责任规定不完善、以及电子证据真实性认定标准模糊等积弊,导致未授权交易纠纷的妥善解决仍是一个任重道远的问题。故而,需要对第三方支付未授权交易问题开展较为透彻的剖析,并有针对性地探索第三方支付未授权交易解决机制可能的改良与革新。

As a new payment model,third-party payment has greatly highlighted the advantages of efficiency in practice,but it can still be further explored at the theoretical level of legal value.On the one hand,the difference and uniqueness between the ternary structure and the traditional structure of third-party payment make the unauthorized transaction specification unable to be effectively applied in the third-party scenario;on the other hand,China's third-party payment unauthorized transaction mechanism is not practical.Although the unauthorized transaction settlement mechanism of third-party payment in China has shown the characteristics of systematization in form,the promulgation and implementation of the Electronic Commerce Law of the People's Republic of China also show the thinking of protecting the rights and interests of payment users,the long-standing malpractices such as the absence of the concept of unauthorized transaction of third-party payment,the imperfect provisions of the burden of proof,and the vague standard for determining the authenticity of electronic evidence result in the fact that it is still a long way to go to properly resolve the dispute of unauthorized transaction.Therefore,it is necessary to carry out a more thorough analysis of the problem of unauthorized transactions of third-party payment,and explore the possible improvement and innovation of the unauthorized transaction settlement mechanism of third-party payment.
