检察机关参与农村矛盾纠纷多元化解机制的进路探究

Exploring the Approaches of the Diversified Mechanism for Resolving Contradictions and Disputes in the Participation of Procuratorial Organs

在加快推进乡村振兴、打造和美乡村进程中,如何高效化解矛盾纠纷一直是乡村社会治理研究的重点和核心。国家和各级政府层面也一直努力探索针对性策略,以降低社会治理成本。但检察机关现有多元解纷机制运行模式存在协作体之间配合不到位、协作主体的功能发挥不足、民众法治意识不强、寻求解决途径的个体意愿不高等问题。激发多元矛盾纠纷化解机制的应有活力,助推乡村社会治理现代化建设,需要从制度完善、队伍建设、服务平台打造、信息化嵌入、法治和德治结合、评价激励机制优化等多层面进行全方位的提升和改进,以充分发挥其定纷止争、保障社会和谐稳定的作用。

In the process of accelerating rural revitalization and building a harmonious countryside,how to efficiently resolve contradictions and disputes has always been the focus and core of rural social governance research.The country and various levels of government have also been trying to find targeted strategies to reduce the cost of social governance.However,there are some problems in the existing operation mode of Procuratorial Organs,multiple dispute resolution mechanism,such as inadequate coordination between the collaborative bodies,insufficient function of the collaborative subjects,weak awareness of the rule of law of the people,and low individual willingness to seek solutions.To stimulate the vitality of the multi-conflict and dispute resolution mechanism and promote the modernization of rural social governance,it is necessary to attract and empower from multiple aspects such as institutional improvement,team building,service platform building,information embedding,the combination of rule of law and moral governance,and optimization of evaluation and incentive mechanisms,so as to give full play to its role in settling disputes and ensuring social harmony and stability.
