摘要
目前,网络远程勘验的实际功能不断突破“勘验”的性质,与远程搜查和网络技术侦查存在混用及交叉。应当让网络远程勘验回归“勘验”的本质属性,厘清其与网络在线提取、远程搜查和网络技术侦查之间的界限,并以此为基础考察网络远程勘验实践运行状况,对网络远程勘验进行程序规制。
At present,the actual function of network remote inspection constantly breaks through the nature of“inspection”,and is often mixed up with remote search and network technical investigation.It is advisable to restore network remote inspection to its essential attribute of“inspection”,clarify the boundary between the network remote inspection and online extraction,remote search and network technical investigation,investigate the operation of it,and put procedural regulations on it.
