过量矛盾纠纷如何解决是当今我国司法制度面临的时代命题,司法制度的演进和数字治理的发展共同指向了“多元解纷+数字治理”的纠纷调解机制。该模式使二者在司法的横向维度与纵向维度相互配合协作,但仍存在在线调解机制统筹组织程度不足、在线调解机制的发展受技术手段发展的掣肘,以及对社会关系恢复能力缺失等问题。针对上述问题,文章提出以“多元解纷”模式构造、结构选择、管理趋势需求为导向引领“数字治理”发展,以提升技术信息能力、完善技术规范能力、革新技术组织能力的手段增强“多元解纷”能力,以在线调解规定优化“多元解纷+数字治理”模式,加强“多元解纷”与“数字治理”的协同合作的完善进路。

How to solve excessive contradictions and disputes is the topic of The Times faced by China's judicial system today.The evolution of judicial system and the development of digital governance jointly point to the dispute mediation mechanism of“multiple dispute resolution+digital governance”.This model enables the two to cooperate in the horizontal and vertical dimensions of justice,but there are still problems such as insufficient overall organization of online mediation mechanism,the development of online mediation mechanism is hampered by the development of technical means,and the lack of ability to recover social relations.In response to the above problems,it is proposed to guide the development of“digital governance”by the construction,structure selection and management trend needs of“multiple dispute resolution”mode,enhance the ability of“multiple dispute resolution”by means of improving technical information capabilities,improving technical specification capabilities and innovating technical organization capabilities,and optimize the“multiple dispute resolution+digital governance”mode through online mediation provisions,strengthen the coordination and cooperation of“diversity resolution”and“digital governance”.
