完善基层公益诉讼检察参与社会治理的对策分析

Analysis of the Countermeasures to Improve the Grassroots Public Interest Litigation Procuratorial Participation in Social Governance

随着社会的发展,基层公益诉讼的重要性日益凸显。作为社会治理的重要参与者,检察机关在基层公益诉讼中具有重要作用。本文对当前公益诉讼检察参与社会治理的情况进行分析,并在此基础上找出了基层公益诉讼检察参与社会治理存在的问题,如社会认知度不足、应用层面受限、效用与回报不匹配以及办案经费保障不到位等。最后有针对性的提出了相应的解决措施,包括增加法制教育普及,推广公益诉讼、优化公益诉讼工作机制,政府部门提供必要的资金支持、技术支持和人力保障以及建立公益诉讼的评估机制等这些对策和建议,可以有效地推动基层公益诉讼的进一步发展和提升检察机关在社会治理中的作用。

With the development of society,the importance of grassroots public interest litigation has become increasingly prominent.As an important participant in social governance,procuratorial organs play an important role in grassroots public interest litigation.This paper analyzes the current situation of public interest litigation prosecutorial participation in social governance,and on this basis,identifies the existing problems of grassroots public interest litigation procuratorial participation in social governance,such as insufficient social awareness,limited application level,mismatch between utility and return,and insufficient funding for handling cases.Finally,the corresponding solutions are put forward,including increasing the popularization of legal education,promoting public interest litigation,optimizing the working mechanism of public interest litigation,providing necessary financial support,technical support and human resources guarantee by government departments,and establishing the evaluation mechanism of public interest litigation.These countermeasures and suggestions can effectively promote the further development of grassroots public interest litigation and enhance the role of procuratorial organs in social governance.
