摘要
楼道属于公共区域,既是日常出行的主要通道,又往往是事故发生时逃生的唯一通道,对人民群众的生命安全具有举足轻重的意义。本文通过对廖某诉王某、某物业公司健康权纠纷案的分析以及两审法院判决的解读,从学理角度、司法实务角度,对楼道杂物堆放人对火灾发生是否具有过错,物业公司是否负有及时清理楼道堆放物,排除火灾隐患的法定义务,及在第三人侵权的情况下,物业公司应承担的责任形式予以明确的同时,探讨了物业公司承担侵权补充责任的合理边界,对治理楼道堆积杂物等消防隐患活动的良性开展具有导向性意义,既有利于被侵权人的损害及时得到填补,更有利于实现侵权当事人的利益衡平,切实发挥了司法裁判参与社会治理的积极作用。
The corridor is a public area,which is not only the main passage of daily travel,but also the only way to escape when an accident occurs.It is of great significance for the safety of the people's lives.This article analyzes the case of a dispute over the right to health between Liao,Wang and a property management company,as well as the interpretation of the judgment of the second instance court.From the perspectives of academic theory and judicial practice,it clarifies whether the person responsible for stacking debris in the corridor was at fault in the event of a fire,whether the property management company has the legal obligation to promptly clean up the stacked materials in the corridor,eliminate fire hazards.At the same time,the form of liability that property companies should bear is clarified,and the reasonable boundary of the supplementary liability of property companies for infringement is discussed,which has guiding significance for the benign development of fire hidden danger activities such as the control of debris accumulation in the corridor.It is not only conducive to timely filling of the damage caused by the infringed party,but also conducive to achieving the balance of the interests of the infringing parties,effectively playing a positive role in judicial participation in social governance.
