国有企业合同管理存在的风险及其防范对策

The risk of contract management in state-owned enterprises and its countermeasures

随着我国经济社会的不断发展,企业内部各项管理体制也随之完善。各方面的管理问题逐渐暴露,其中部分国有企业因法律意识淡薄从而存在法律方面的风险,这类问题往往表现在合同管理过程中,亟须改进和完善。鉴于此,文章对国有企业加强合同管理的相关内容进行讨论,从其含义和意义出发,梳理企业加强合同管理时应克服的难点,分别从合同起草、合同审查、合同风险、合同执行、合同管理体系以及合同管理监督等多个维度进行梳理,并提出相应的优化策略,旨在为国有企业加强合同管理中的风险防范能力提供有益参考。

Along with the continuous development of our economic society,various management systems within the enterprise are also improved.Management problems in all aspects are gradually exposed,among which some state-owned enterprises have legal risks because of their weak legal awareness.Such problems are often manifested in the process of contract management and need to be improved and per-fected.In view of this,this paper discusses the relevant contents of strengthening contract management in state-owned enterprises.Starting from its meaning and significance,it sorts out the difficulties that enterprises should overcome when strengthening contract management,and sorts out the aspects of contract drafting,contract review,contract risk,contract execution,contract management system and contract management supervision respectively,and puts forward corresponding optimization strategies.The purpose is to provide useful reference for state-owned enterprises to strengthen the risk prevention ability in contract management.
