摘要
自“田永案”打破高校处理或处分决定不可诉的先例后,高校学生申诉与行政诉讼之间缺乏衔接机制的问题随之暴露,这种衔接机制的缺乏不仅增大了学生维权难度,还影响了高校学生申诉和行政诉讼各自功能发挥。解决该问题,应当将高校处理或处分决定分流为自主管理行为和高校行政行为作为逻辑起点,并根据两者是否具有行政职权因素,分别构建“校内申诉—行政申诉”和“校内申诉—行政诉讼”两步走式的程序适用机制,防止不必要的程序堆叠。
Since the“Tian Yong Case”broke the precedent that the handling or punishment decision of colleges and universities is not actionable,the problem of the lack of linkage mechanism between college and university students'appeal and administrative litigation has been exposed.The lack of such linkage mechanism not only increases the difficulty of students'rights protection,but also affects the respective functions of college and university students'appeal and administrative litigation.To solve this problem,the logical starting point is to divide handling or punishment decision of colleges and universities into autonomous management acts and administrative acts of colleges and universities,and construct a two-step procedural application mechanism of“internal appeal-administrative appeal”and“internal appeal-administrative litigation”respectively according to whether they have administrative authority,so as to prevent unnecessary procedure stacking.
