不动产登记的公法思考

Thinking the Registration of Real Estate from Public Law's Perspective

在我国《物权法》起草过程中,围绕着应当构建何种性质、何种形式的不动产登记制度,理论界和实践部门争论颇多。鉴于我国《物权法》的起草是在带有极强的私法色彩和氛围下进行的,本文尝试从公法角度对不动产登记机关,不动产登记的性质、价值和功能,以及与之相关的司法审查等问题进行初步分析,以期能对物权法的制定提供有益的参考。

In the process of drafting China's Real Right Law,there is much debate involving with the nature and form of real estate registration system.Considering that the drafting of China's Real Rights Law is conducted in a strong atmosphere of private law,this article attempts to discuss the registration of real estate from the public law's perspective,which includes the registration office,the nature,value,function of real estate registration,and related judicial review.The author hopes that the article will serve as useful references for the legislation of the Real Right Law.
