摘要
本文关注的是不动产登记制度的相关问题。首先给予不动产登记法公私法兼融的程序法定位;其次以物权法为背景,对不动产登记制度予以设计,着重论述了登记事项的范围、登记的效力、各种类型的登记制度以及登记机关的赔偿责任;最后对我国的不动产登记法作出基本的设计,主要涉及不动产登记机关的统一和登记人员的设置、程序的统一、类型的完善以及费用的负担问题。
The article concerns mainly about the registration of the real estate.In the first part of the article,the author maintains that the law of registration is procedural law and is the mixture of private law and public law.Then in the second part,the author designs the system of the registration of the real estate under the background of property law,and elaborates the scope,effect,type of the registration of the real estate and the liability of the registration office.The third part focuses on the design of the registration law of the real estate in China,mainly involving the unity of the registration office and its staff,the unity of the procedure,the integrity of the type and registration fee.
