Religious Analysis of Law

本文首先探讨了法律价值的演变过程,进而分析了政教分离的宪法原则所包含的法律与宗教关系的实质内涵,最后从法律的目的、法律权威的依据和法律的根基等三个方面指出了宗教对于世俗法律的提升意义。本文认为,法律与宗教的关系问题涉及法律背后的价值基础,尽管法律在有限的范围内是自主性的,但法律的最终价值或道义之根基,是法律自己无法给出来的。因此,对法律进行宗教视角的分析,探讨法律的正义性基础仍然是十分必要的。

At first,the article explores the evolution of the value of law.Then it analyzes the connotation of the relationship between law and religion as embodied in the constitutional principle of church-state separation.Finally,the article points out the role of the religion in elevating temporal law to a higher level in terms of the purpose of law,the foundation of legal authority,and the basis of law.The author maintains that the relationship between law and religion involves the value basis of law.Although it is independent to some extent,law by itself cannot offer its own foundation,which should be some ultimate value.Hence it is necessary to probe into the justice basis of law from a religious perspective.
