摘要
“新冠”疫情的暴发,凸显出我国当前卫生应急法律体系中的诸多短板。群体性不明原因疾病与其他公共卫生事件不加区别地对待的立法模式,以及其在《传染病防治法》中的缺位,是导致“新冠”疫情蔓延的重要原因。深入践行“以人为本、生命至上”法治理念;将群体性不明原因疾病视为传染病予以防控,从赋予地方政府一定的行政应急权、赋予医疗机构对患者临时控制隔离权、建立完善的应急组织机构、建立灵敏的预警系统、建立强有力的人力物资保证系统等视角去强化法律制度保障,完善传染病防治法律制度,建立高效的应急管理体系,是提升群体性不明原因疾病应急能力的重要路径。
The outbreak of"COVID-19"epidemic highlights many weaknesses in China's current health emergency legal system.The legislative model of group diseases with unknown causes and other public health events that are treated indiscriminately,as well as its absence in the Law on the Prevention and Treatment of Infectious Diseases,are important reasons for the spread of the"COVID-19"epidemic.Deeply implement the rule of law concept of"people-oriented,life first";The prevention and control of mass diseases of unknown causes as infectious diseases should be strengthened from the perspectives of giving local governments certain administrative emergency powers,giving medical institutions temporary control and isolation rights for patients,establishing a sound emergency organization,establishing a sensitive early warning system,and establishing a strong human and material assurance system,to improve the legal system for infectious disease prevention and control,and establishing an efficient emergency management system,It is an important way to improve the emergency response capacity of mass diseases of unknown causes.
