由某职业卫生案件引发的思考

摘要 通过梳理某职业卫生健康案件办理始末,结合处置调查程序,分析该案件事实认定、法律适用实务中的若干问题,并对关于用人单位职业病危害因素性质的分类原则、执法记录仪在当事人涉密部门的使用限制、职业健康行政处罚中“及时改正”的认定等方面提出对策建议。填补监督执法环节薄弱点,积极响应国家卫生健康委《关于开展职业卫生分类监督执法试点工作的通知》,依托本案件体现出的监督执法活动进一步探索职业卫生分类监督执法的试点实践意义,为下一步试点在更多地域的推广积累经验。 By sorting out the handling of an occupational health and health case and combining with the handling and investigation procedures,this paper analyzed several problems in the fact determination and law application practice of the case,and put forward countermeasures and suggestions on the classification principle of the nature of the occupational disease hazard factors of the employer,the restrictions on the use of the law enforcement recorder in the secret-related departments of the parties,and the determination of"timely correction"in the occupational health administrative punishment,and fills in the weak points of supervision and law enforcement.It also actively responded to the Notice of the National Health Commission on Carrying out the Pilot Work of Classified Supervision and Law Enforcement of Occupational Health,and further explored the practical significance of the pilot work of classified supervision and law enforcement of occupational health based on the supervision and law enforcement activities reflected in this case,so as to accumulate experience for the promotion of the next pilot in more regions.
